Producer Brett Ratner files a libel lawsuit against a rape accuser

48-year-old American producer, Brett Ratner, who has been accused of rape responds to Melanie Kohler’s accusations with a libel lawsuit. 

Roberta Kaplan, a civil rights attorney and the leader of Kohler’s legal team, attempted to seek dismissal of Ratner’s lawsuit in a federal Hawaii court this Tuesday. Her motion states, "As the Supreme Court has made clear, such threadbare, conclusory allegations are patently insufficient as a matter of law."

According to Kohler, the lawsuit should be dismissed since it is a “blank piece of paper" that does not correspond to basic legal standards. She went on stating that this lawsuit is another case of a rich and powerful Hollywood persona trying to put pressure on her First Amendment right and that it is "an apparent effort to intimidate other women from speaking out" on sexual harassment and misconduct cases. 

According to Kohler’s motion, they are dealing with a SLAPP suit, Strategic Lawsuit Against Public Participation. These cases are usually brought up to stop discourse on matters important to the public. Referencing to California’s Anti-SLAPP law, the motion also states, "A public figure like (Ratner) cannot lawfully chill speech about his conduct by filing a complaint that merely recites the elements of his cause of action."

Last year, Kohler posted on Facebook saying that the Hollywood producer has raped her years ago in Los Angeles. At the time, Kohler worked for a talent agency. The post, however, was deleted after Ratner’s attorney reached out to Kohler. Days later, Ratner filed his libel lawsuit. 

Ratner had to pause his work on all his projects in collaboration with Warner Bros., and Playboy Enterprises. Six other women have come forward with sexual harassment and misconduct accusations against the Hollywood producer, however, only one - Melanie Kohler - is involved in a lawsuit at this moment. Brett Ratner has produced a number of Hollywood films like “X-men: The Last Stand” (2006), “Hercules” (2014), “Rush Hour” (1998), “New York, I Love You” (2008), and others.
